As far as I know eBay's Terms require a product to be placed in the right category. "Cell Phones & PDAs > Cell Phones & Smartphones" is definately wrong. I hope the buyer won't pay for it...
BTW: I've read somewhere that if someone sends a complaint about such an auction to ebay they'll cancel the auction.
